Something's happened in the Padilla case, but we're not sure quite what.
Padilla is an american citizen - a gangbanger from chicago - who was first arrested in a dirty bomb scare, and then held indefinately without charges.
His military detention had been upheld by the 4th circuit, but the Supreme Court (we think?) had agreed to take the case, at which point the government caved and sent him to a regular jail and filed c
charges. So what we think the court ruled, 6-3, was that the case should now be dismissed as moot.
ok, a nyt article helped. what happened was, in a rare move, 3 of those who voted not to take the case filed an opinion explaining why. ginsberg wrote a dissent to the denial.
it's the second time the case has come to the high court - the government keeps moving him around, playing games.
